FAQs
What taxes does a non-resident pay in Spain on a property?
It depends on how the property is used. If the property is at the owner’s disposal, for personal use or empty, the usual case is to pay Non-Resident Income Tax (IRNR) on the imputed income, via Modelo 210. If the property is rented, IRNR is paid on the rental income, also via Modelo 210. And if the property is sold, the non-resident pays tax on the capital gain; in addition, the buyer must withhold and pay in the 3% retention of the price via Modelo 211 as a payment on account of the non-resident seller’s tax. The AEAT expressly sets out these three cases and their taxation rules.
When must Modelo 210 be filed?
There is not a single date, because the deadline depends on the type of income. For imputed income on urban property, the return is filed in the following calendar year after the accrual on 31 December. For rentals with an amount payable, the general filing period is the first twenty calendar days of January of the following year. And for the sale of a property, the Modelo 210 deadline is three months, once the one-month period from the date of transfer has elapsed.
