What is a temporary disability certificate?
Temporary incapacity (TI) is a situation in which an employee is temporarily unable to perform their job due to a common illness, workplace accident, occupational disease, or non-work-related accident. Its proper management is crucial for both the employee and the company, as it directly affects the administrative, financial, and legal obligations of both parties.

Temporary disability management for companies
A temporary incapacity certificate is the official document that certifies that a worker is on sick leave. This certificate is issued by a doctor in the public health system or by a doctor from the mutual insurance company, depending on the type of contingency. There are different types of certificates:
- Medical leave certificate: issued when the employee begins their period of incapacity.
- Confirmation certificates: issued periodically for the duration of the leave.
- Medical discharge certificate: issued when the employee is fit to return to work.
These documents must be submitted to the company and Social Security on time so that the corresponding financial benefits can be processed.
Obligations of the employee and the company
Employee obligations
- See a doctor for an assessment of your health.
- Submit the sick leave certificate, confirmation or medical discharge to the company within 3 business days from the date of issue.
- Keep your employer informed about your condition.
Since 2023, medical certificates no longer need to be physically submitted by the employee; the system itself communicates them electronically to Social Security and the company through the RED system. However, the employee must continue to inform the company of their situation.
Company obligations
- Communicate to Social Security the data necessary for the management of IT through the RED system.
- Make the corresponding payments if you are on a delegated payment scheme.
- Keep proper track of the duration of sick leave and confirmation reports.
- Avoid errors or omissions that could affect the worker's receipt of the subsidy.

Types of temporary disability and their management
Common illness or non-work-related accident
- The sick pay benefit begins on the fourth day of sick leave.
- From the 4th to the 15th, the company pays.
- From the 16th onwards, it is taken over by Social Security or the mutual insurance company, as the case may be.
- The company must continue to manage the reports and send the information through the RED system.
Work accident or occupational disease
- The benefit begins the day after the sick leave, and the payment is made by the collaborating mutual insurance company from the very beginning.
- The accident report is communicated through the Delt@ system.
Correctly identifying the contingency is essential to avoid payment delays or subsequent claims.
