La province d&rsquo;Alicante compte plus de 50 000 r\u00e9sidences touristiques enregistr\u00e9es.<br \/><br \/><br \/>\u00c0 partir du 26 juin prochain, les plateformes de location touristique seront \u00e0 nouveau tenues d&rsquo;informer l&rsquo;Agence fiscale de l&rsquo;identit\u00e9 des propri\u00e9taires des appartements qu&rsquo;elles commercialisent et des revenus qu&rsquo;elles en tirent. Le Journal Officiel de l&rsquo;\u00c9tat a publi\u00e9 hier le nouveau mod\u00e8le de d\u00e9claration \u00e0 remplir par ces op\u00e9rateurs, ce qui compl\u00e8te le processus initi\u00e9 par le Gouvernement pour r\u00e9cup\u00e9rer cette obligation apr\u00e8s qu&rsquo;il y a environ un an la Cour Supr\u00eame ait annul\u00e9 le r\u00e8glement pr\u00e9c\u00e9dent pour ne pas avoir communiqu\u00e9 son approbation \u00e0 la Commission europ\u00e9enne.<br \/><br \/>La nouvelle a \u00e9t\u00e9 applaudie hier par le patronat h\u00f4telier Hosbec et l&rsquo;Association des appartements touristiques (Aptur), qui ont toujours d\u00e9nonc\u00e9 la croissance exponentielle des locations irr\u00e9guli\u00e8res et la concurrence,\u00a0<strong>selon lui d\u00e9loyale<\/strong>, qui a conduit \u00e0 l&rsquo;arriv\u00e9e de ces sites web. \u00ab\u00a0La relance du tourisme ne profitera pas seulement aux h\u00f4tels, mais aussi \u00e0 toute cette industrie parall\u00e8le de l&rsquo;h\u00e9bergement qui a \u00e9t\u00e9 cr\u00e9\u00e9e. Et s&rsquo;il \u00e9tait auparavant n\u00e9cessaire de lutter contre l&rsquo;\u00e9conomie souterraine, c&rsquo;est encore plus vrai maintenant.<strong>\u00a0Tout le monde doit payer ses imp\u00f4ts<\/strong>\u00ab\u00a0, d\u00e9clare la secr\u00e9taire g\u00e9n\u00e9rale d&rsquo;Hosbec, Nuria Montes, qui rappelle les \u00e9normes sommes d&rsquo;argent qui font bouger ces plateformes.<br \/><br \/><br \/>Ainsi, selon les \u00e9tudes men\u00e9es par cet employeur avec des techniques de Big Data, seuls les deux principaux op\u00e9rateurs &#8211; Airbnb et Vrbo, l&rsquo;ancien Home Away &#8211; ont facturer\u00a0plus de 41 millions euros pour la<br \/>les locations dans la ville d&rsquo;Alicante en 2019 &#8211; le chiffre a \u00e9t\u00e9 divis\u00e9 par deux l&rsquo;an dernier par la pand\u00e9mie &#8211; et 29\u00a0millions euro \u00e0 Benidorm. Un argent qui, sans cette d\u00e9claration, a plus de facilit\u00e9 \u00e0 s&rsquo;\u00e9chapper du tr\u00e9sor public.<br \/><br \/><br \/>Il \u00e9tait \u00e9galement favorable \u00e0 ce contr\u00f4le accru Miguel Angel Sotillos, pr\u00e9sident de l&rsquo;Association des entreprises d&rsquo;appartements touristiques de la Costa Blanca (Aptur), qui rappelle qu&rsquo;en fait, la nouvelle obligation touche tous ceux qui interviennent dans une location touristique, et pas seulement les plateformes.\u00a0<strong>\u00ab\u00a0Ce qui est juste, c&rsquo;est que tout le monde paie et que l&rsquo;Agence fiscale contr\u00f4le tout le monde, pas seulement les entreprises\u00a0\u00bb<\/strong>, affirme M. Sotillos qui, oui, est persuad\u00e9 que cette fois le syst\u00e8me est \u00ab\u00a0moins lourd\u00a0\u00bb que le pr\u00e9c\u00e9dent, annul\u00e9 par la Cour supr\u00eame.<br \/><br \/><br \/>En ce sens, le pr\u00e9sident d&rsquo;Aptur rappelle que sur la Costa Blanca les locations priv\u00e9es repr\u00e9sentent une grande partie de l&rsquo;offre de logements et que la r\u00e9glementation exige \u00e9galement que tous les logements qui sont annonc\u00e9s sur ces sites web soient inscrits au registre des logements touristiques de la Generalitat. \u00ab\u00a0Le probl\u00e8me est que les plateformes ne v\u00e9rifient pas la v\u00e9racit\u00e9 du num\u00e9ro d&rsquo;enregistrement qui est ins\u00e9r\u00e9\u00a0\u00bb, regrette Sotillos.<br \/><br \/><br \/>Malgr\u00e9 cela, les campagnes men\u00e9es par le gouvernement r\u00e9gional ont permis d&rsquo;enregistrer et de recueillir les donn\u00e9es de plus de 81.000 foyers dans toute la Communaut\u00e9, selon le pr\u00e9sident d&rsquo;Aptur, dont 65%, soit plus de 52 000, se trouvent dans la province d&rsquo;Alicante.<br \/><br \/><br \/><strong>\u00c9trangers<\/strong><br \/><br \/>L&rsquo;organisation des entreprises estime que la d\u00e9cision du bureau de taxe (AEAT)\u00a0d&rsquo;obliger les plateformes \u00e0 leur fournir toutes les informations facilitera un plus grand volume d&rsquo;activit\u00e9 l\u00e9gale, m\u00eame s&rsquo;il existe encore des failles. \u00ab\u00a0Il y a des cas, comme les \u00e9trangers qui vendent leurs biens sur des sites web dans leur propre pays, qui sont impossibles \u00e0 contr\u00f4ler\u00a0\u00bb, a d\u00e9clar\u00e9 le porte-parole des entreprises.<br \/><br \/><br \/>Apr\u00e8s l&rsquo;annulation de la r\u00e9glementation pr\u00e9c\u00e9dente en Juillet de l&rsquo;ann\u00e9e derni\u00e8re, le gouvernement a profit\u00e9 du d\u00e9cret qui a approuv\u00e9 la soi-disant \u00ab\u00a0taxe Tobin\u00a0\u00bb aux transactions financi\u00e8res pour sneak un article avec lequel de r\u00e9cup\u00e9rer cette obligation, mais \u00e9tait en attente de l&rsquo;approbation du mod\u00e8le de la d\u00e9claration. Avec sa publication ce vendredi au BOE, la mesure pourrait entrer en vigueur le 26 juin, de sorte qu&rsquo;elle recueillera d\u00e9j\u00e0 les op\u00e9rations effectu\u00e9es cet \u00e9t\u00e9, au moment o\u00f9 l&rsquo;activit\u00e9 de ces sites est habituellement plus importante. \u00c0 partir de ce moment, les plateformes doivent d\u00e9clarer trimestriellement \u00e0 l&rsquo;Agence fiscale tous les revenus vers\u00e9s aux propri\u00e9taires des appartements.<br \/><br \/><br \/><strong>Une fiscalit\u00e9 diff\u00e9rente de la location traditionnelle<\/strong><br \/><br \/>L&rsquo;imposition des revenus des locations touristiques est beaucoup plus \u00e9lev\u00e9e que celle des locations traditionnelles. Dans ce dernier cas, lorsqu&rsquo;il s&rsquo;agit d&rsquo;un bien lou\u00e9 \u00e0 titre de r\u00e9sidence habituelle, le propri\u00e9taire b\u00e9n\u00e9ficie d&rsquo;une exon\u00e9ration de 60%, dont ne b\u00e9n\u00e9ficie pas la location touristique.
