qu&rsquo;il paie le gain patrimonial obtenu lors de la vente de la maison et qu&rsquo;il soit pay\u00e9 \u00e0 la fois par les r\u00e9sidents et les r\u00e9sidents en retenus par l&rsquo;acheteur qui est le contribuable \u00e0 payer. Et celui qui est oblig\u00e9 a payer la taxe au fisc espagnole.<\/p><p>En d&rsquo;autres termes, si vous n&rsquo;\u00eates pas r\u00e9sident et que vous vendez une maison en Espagne, l&rsquo;acheteur de votre maison, qu&rsquo;il soit r\u00e9sident ou non-r\u00e9sident, est tenu de retenir 3 % du prix de vente et de le payer \u00e0 l&rsquo;administration fiscale espagnole dans un d\u00e9lai d&rsquo;un mois au moyen du mod\u00e8le 211.<\/p><p>Ceci est g\u00e9n\u00e9ralement fait par le <strong>conseiller fiscal <\/strong>\u00e0 qui vous represente a l&rsquo;acte chez le notaire pour achetez la maison.<\/p><h3>Exemple pratique, de la retenue de 3 %<\/h3><p>Vous avez vendu votre maison le 19 novembre et le prix de vente de l&rsquo;acte est de 250.000 \u20ac.<\/p><p>3 % x 250.000 = 7.500 \u20ac<\/p><p>Comme il s&rsquo;agit d&rsquo;une retenue, la valeur de 3 % du prix d&rsquo;achat, l&rsquo;acheteur la d\u00e9duit du prix de vente et l&rsquo;apporte au bureau de taxe espagnole, c&rsquo;est-\u00e0-dire que l&rsquo;acheteur vous paiera 242 500 \u20ac (moins d&rsquo;autre retenues \u00e9ventuelles)<\/p><p><strong>Dans notre exemple<\/strong>, l&rsquo;acheteur de la maison devra verser 7.500 \u20ac \u00e0 l&rsquo;agence fiscale en pr\u00e9sentant le mod\u00e8le 211 et la date limite est le 19 du calcul de votre imp\u00f4t sur les plus-values, l&rsquo;une des deux situations suivantes se produit :<\/p><ol><li><strong>Lorsqu&rsquo;il n&rsquo;y a pas eu de gain<\/strong> (ou que le gain est inf\u00e9rieur) :<ul><li>Si le calcul de l&rsquo;imp\u00f4t sur le revenu des non-r\u00e9sidents (IRNR) montre que l&rsquo;imp\u00f4t r\u00e9el \u00e0 payer est inf\u00e9rieur \u00e0 3 % retenu.<\/li><li>Ou si, directement, la vente de la propri\u00e9t\u00e9 ne vous a g\u00e9n\u00e9r\u00e9 aucun gain en capital (m\u00eame si vous avez subi des pertes).<\/li><\/ul><\/li><li><strong>Lorsqu&rsquo;il y a exemption<\/strong>:<ul><li>Si vous remplissez l&rsquo;une des conditions d&rsquo;exon\u00e9ration fiscale (bien qu&rsquo;il s&rsquo;agisse de De nombreux non-r\u00e9sidents perdent le droit au remboursement pour non-respect de ces d\u00e9lais :<\/p><ul><li><strong>D\u00e9lai de soumission<\/strong> : Vous disposez de <strong>trois mois<\/strong> \u00e0 compter de la fin du d\u00e9lai dont disposait l&rsquo;acheteur pour verser la retenue (mod\u00e8le 211).<\/li><li><strong>En pratique<\/strong> : Vous avez g\u00e9n\u00e9ralement <strong>quatre mois<\/strong> \u00e0 compter de la date de l&rsquo;acte authentique de vente pour soumettre votre demande de retour via le mod\u00e8le 210.<\/li><\/ul><p>\u26a0\ufe0f <strong>Attention<\/strong> ! Si vous pr\u00e9sentez le mod\u00e8le 210 en dehors de ce d\u00e9lai de trois mois (ou quatre \u00e0 compter de la vente), le Tr\u00e9sor a le droit l\u00e9gal de refuser le remboursement, m\u00eame si vous n&rsquo;avez rien \u00e0 payer.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<section
