Si vous l&rsquo;affiliez, on suppose que vous ne saviez pas qu&rsquo;il touchait des allocations ch\u00f4mage, car automatiquement, d\u00e8s son affiliation, il cesse de percevoir ses allocations.<\/p>\n<ul>\n<li><strong>Vous pouvez \u00eatre condamn\u00e9 \u00e0 une amende<\/strong> SI vous n&rsquo;inscrivez PAS le travailleur qui touche des allocations ch\u00f4mage.<br \/>C&rsquo;est logique, outre le fait que ne pas inscrire un travailleur est en soi ill\u00e9gal. L&rsquo;inspection du travail peut pr\u00e9sumer que vous \u00e9tiez de m\u00e8che avec le travailleur pour qu&rsquo;il continue \u00e0 toucher ses allocations.<\/li>\n<\/ul>\n<p>Bien que nous ayons d\u00e9j\u00e0 r\u00e9pondu \u00e0 la question, nous allons approfondir un peu plus ce sujet dans les lignes qui salari\u00e9 <strong>sont incompatibles.<\/strong><\/p>\n<p>\u00c0 cet \u00e9gard, l&rsquo;exercice d&rsquo;un travail salari\u00e9 d&rsquo;une <strong>dur\u00e9e inf\u00e9rieure \u00e0 12 mois entra\u00eene la suspension<\/strong> des allocations ch\u00f4mage et doit \u00eatre signal\u00e9 \u00e0 la S\u00e9curit\u00e9 sociale.<\/p>\n<p>Si cette <strong>dur\u00e9e est sup\u00e9rieure \u00e0 12 mois, cela entra\u00eene la suppression desdites allocations.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<section data-particle_enable=\"false\" travail pour le compte d&rsquo;un tiers pendant qu&rsquo;il per\u00e7oit une prestation incompatible avec ce travail, il commet une infraction grave et est sanctionn\u00e9 par la perte de cette prestation pendant trois mois.<\/p>\n<p>Si la prestation per\u00e7ue par le travailleur est une allocation de ch\u00f4mage, l&rsquo;exercice d&rsquo;un travail incompatible constituera une infraction tr\u00e8s grave, ce qui entra\u00eenera la suppression totale de la prestation.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<section data-particle_enable=\"false\" d\u00e9pend<\/p>\n<h3>Communication au SEPE et inscription obligatoire \u00e0 la s\u00e9curit\u00e9 sociale<\/h3>\n<p>Si vous embauchez un travailleur qui per\u00e7oit une prestation incompatible avec le travail, assurez-vous que cette embauche est communiqu\u00e9e au SEPE et proc\u00e9dez \u00e0 son inscription \u00e0 la s\u00e9curit\u00e9 sociale.<\/p>\n<p>Si vous n&rsquo;inscrivez pas la personne concern\u00e9e avant le d\u00e9but de la prestation de services, vous commettez une infraction tr\u00e8s grave pouvant \u00eatre sanctionn\u00e9e d&rsquo;une amende comprise entre 12.001 et 225.018 euros.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<section data-particle_enable=\"false\" data-particle-mobile-disabled=\"false\" class=\"elementor-section elementor-top-section elementor-element elementor-element-747cd16 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"747cd16\" data-element_type=\"section\" data-e-type=\"section\">\r\n\t\t\r\n\t\t\t\t\t\t\t<div class=\"elementor-container travail ne pourra infliger que l&rsquo;amende minimale (12 000 euros).<\/p>\n<p>Toutefois, si plusieurs travailleurs sont concern\u00e9s, le montant de l&rsquo;amende sera major\u00e9 comme suit :<\/p>\n<ul>\n<li><strong>20 %<\/strong> pour chaque infraction lorsqu&rsquo;il s&rsquo;agit de <strong>deux travailleurs.<\/strong><\/li>\n<li><strong>30 %<\/strong> pour chaque infraction lorsqu&rsquo;il s&rsquo;agit de <strong>trois travailleurs.<\/strong><\/li>\n<li><strong>40 %<\/strong> pour chaque infraction lorsqu&rsquo;il s&rsquo;agit de <strong>quatre travailleurs.<\/strong><\/li>\n<li><strong>50 %<\/strong> pour chaque infraction lorsqu&rsquo;il s&rsquo;agit de <strong>cinq travailleurs ou plus.<\/strong><\/li>\n<\/ul>\n<p>En aucun cas, la sanction ne <strong>pourra d\u00e9passer 225.018 euros<\/strong> par travailleur.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<section data-particle_enable=\"false\"
