Avec la documentation ci-dessus, vous pourrez accorder l&rsquo;acte de changement d&rsquo;utilisation et l&rsquo;inscrire au registre foncier (si n\u00e9cessaire, le registre v\u00e9rifiera que les licences administratives et l&rsquo;autorisation de la communaut\u00e9 ont \u00e9t\u00e9 obtenues).<\/li><\/ul><p>Vous devez \u00e9galement pr\u00e9senter une <a href=\"https:\/\/www.sedecatastro.gob.es\/Accesos\/SECAccProcedimientos.aspx?Dest=35\" target=\"_blank\" rel=\"noopener\">d\u00e9claration de modification de l&rsquo;utilisation dans le <strong><a href=\"https:\/\/www.asesoriaorihuelacosta.com\/fr\/nouveautes-dans-le-itp-de-la-communaute-valencienne-et-le-itp-de-la-region-de-murcie-en-2024\/\" target=\"_blank\" rel=\"noopener\">l&rsquo;imp\u00f4t sur les transmissions patrimoniales et les actes juridiques document\u00e9s ITP-AJD.<\/a><\/strong><\/p><h3>Crit\u00e8re du Tr\u00e9sor<\/h3><p>Le Tr\u00e9sor reconna\u00eet que les actes de changement d&rsquo;usage ne sont pas impos\u00e9s par l&rsquo;imp\u00f4t sur les actes juridiques document\u00e9s (AJD) si ce changement n&rsquo;implique pas de variation de la valeur cadastrale (cela se produira, par exemple, si le bien immobilier figure d\u00e9j\u00e0 dans le cadastre en tant que logement et que le propri\u00e9taire ne veut que \u00ab\u00a0mettre \u00e0 jour\u00a0\u00bb les informations existantes dans le registre foncier).<\/p><p>Ce n&rsquo;est g\u00e9n\u00e9ralement pas normal<\/p><p>Mais en dehors de cette hypoth\u00e8se, elle consid\u00e8re cette taxe comme applicable &#8211; entre 0,5 et 1,5 % de la valeur totale de la propri\u00e9t\u00e9, selon la communaut\u00e9 autonome -, car, selon elle, les <span style=\"text-decoration: underline;\">conditions pour l&rsquo;exiger sont remplies :<\/span><\/p><ul><li><strong>L&rsquo;acte est formalis\u00e9<\/strong> devant un notaire et peut \u00eatre inscrit dans un registre public.<\/li><li>En outre, il a un contenu pr\u00e9cieux (la valeur de la propri\u00e9t\u00e9)<\/li><\/ul><p>C&rsquo;est discutable.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<section data-particle_enable=\"false\" data-particle-mobile-disabled=\"false\" class=\"elementor-section elementor-top-section elementor-element elementor-element-8159c81 elementor-section-boxed elementor-section-height-default l'hacienda<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<section data-particle_enable=\"false\" data-particle-mobile-disabled=\"false\" class=\"elementor-section elementor-top-section elementor-element elementor-element-423291b elementor-section-boxed elementor-section-height-default data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Eh bien, sachez que certains tribunaux ne sont pas d&rsquo;accord avec le Tr\u00e9sor.<\/p><p>Pour certains, les changements d&rsquo;utilisation n&rsquo;ont pas de contenu pr\u00e9cieux et ne sont pas tax\u00e9s par AJD, tandis que d&rsquo;autres consid\u00e8rent que seuls les travaux d&rsquo;adaptation de la propri\u00e9t\u00e9 sont pr\u00e9cieux.<\/p><p>Selon ce dernier crit\u00e8re, ce changement serait comparable \u00e0 la modification d&rsquo;une d\u00e9claration de construction neuve d\u00e9j\u00e0 enregistr\u00e9e.<\/p><p>Par exemple, si pour changer l&rsquo;utilisation d&rsquo;un local d&rsquo;une valeur de 300 000 euros, des travaux doivent \u00eatre entrepris pour 60 000 euros, la base imposable de l&rsquo;AJD serait le montant de ces travaux.<\/p><h3>La demande de rectification fiscale<\/h3><p>Par cons\u00e9quent, si vous \u00eates confront\u00e9 \u00e0 un changement d&rsquo;utilisation et que le Tr\u00e9sor vous demande de liquider l&rsquo;AJD, <strong>opposez-vous, mais ne jouez pas.<\/strong><\/p><p>Une alternative est de satisfaire l&rsquo;AJD sur la valeur totale du bien et, ensuite, de pr\u00e9senter un m\u00e9moire rectificatif en all\u00e9guant qu&rsquo;il n&rsquo;y a pas d&rsquo;assiette imposable de l&rsquo;AJD, ou qu&rsquo;au moins cette base doit \u00eatre r\u00e9duite \u00e0 la valeur des travaux (et en demandant le remboursement des revenus indus correspondant avec int\u00e9r\u00eats).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<section data-particle_enable=\"false\" data-particle-mobile-disabled=\"false\" class=\"elementor-section elementor-top-section elementor-element elementor-element-c75c457 elementor-section-boxed elementor-section-height-default r\u00e9sum\u00e9<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<section data-particle_enable=\"false\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Selon le Tr\u00e9sor, l&rsquo;acte qui documente le changement d&rsquo;utilisation est impos\u00e9 par AJD pour la valeur totale de la propri\u00e9t\u00e9.<\/p><p>Cependant, il y a des tribunaux qui consid\u00e8rent que ces op\u00e9rations ne sont pas impos\u00e9es ou que l&rsquo;imp\u00f4t est calcul\u00e9 sur la valeur des travaux
