ou d&rsquo;int\u00e9r\u00eat social en \u00e9change d&rsquo;un prix \u00e9quitable -appel\u00e9 juste prix &#8211; (\u00e0 titre d&rsquo;indemnisation pour la perte des biens et droits d\u00e9tenus sur ledit terrain).<\/p><p class=\"p1\">Or, l&rsquo;utilit\u00e9 publique du bien \u00e0 exproprier doit \u00eatre suffisamment justifi\u00e9e ou vous pouvez vous opposer \u00e0 une d\u00e9claration d&rsquo;utilit\u00e9 publique ou d&rsquo;int\u00e9r\u00eat social en ce qui concerne le bien qu&rsquo;elle va exproprier ; c&rsquo;est-\u00e0-dire qu&rsquo;elle doit d\u00e9terminer et d\u00e9crire la raison pour laquelle il est n\u00e9cessaire de lui retirer une partie de son terrain pour construire un \u00e9quipement sportif municipal.<\/p><p>\u00c0 cet effet, la mairie doit :<\/p><ul><li>Formuler une relation concr\u00e8te et individualis\u00e9e de l&rsquo;expropriation, avec une description des biens expropri\u00e9s et de leurs aspects mat\u00e9riels (dimensions, qualit\u00e9 du terrain&#8230;) et juridiques (qui est le propri\u00e9taire, s&rsquo;il y a des charges&#8230;).<\/li><li>Et justifier la n\u00e9cessit\u00e9 de l&rsquo;expropriation avec des donn\u00e9es objectives (par exemple, parce qu&rsquo;il n&rsquo;y a pas d&rsquo;autre \u00e9quipement similaire dans la municipalit\u00e9 &#8211; ou celui qui existe est insuffisant -, parce qu&rsquo;il n&rsquo;y a pas d&rsquo;autre site plus appropri\u00e9 et que seule la partie juste et n\u00e9cessaire sera expropri\u00e9e&#8230;).<\/li><\/ul><h3>All\u00e9gations de l&rsquo;expropri\u00e9<\/h3><p>Si vous n&rsquo;\u00eates pas d&rsquo;accord avec le dossier d&rsquo;expropriation, vous avez le droit de le contester en pr\u00e9sentant les all\u00e9gations appropri\u00e9es dans les 15 jours suivant la notification de la d\u00e9claration d&rsquo;utilit\u00e9.<\/p><p>Les motifs de contestation doivent \u00eatre fond\u00e9s sur la d\u00e9claration d&rsquo;utilit\u00e9, en all\u00e9guant que la mairie n&rsquo;a pas correctement d\u00e9limit\u00e9 l&rsquo;int\u00e9r\u00eat social qui justifie l&rsquo;expropriation (par exemple, que le dossier contient des erreurs de description du bien, que l&rsquo;utilit\u00e9 publique n&rsquo;est pas correctement justifi\u00e9e, qu&rsquo;il existe la possibilit\u00e9 d&rsquo;occuper d&rsquo;autres biens&#8230;).<\/p><h3>R\u00e9solution<\/h3><p>Une fois leurs all\u00e9gations examin\u00e9es, l&rsquo;organe comp\u00e9tent dispose d&rsquo;un d\u00e9lai maximum de 20 jours pour statuer.<\/p><p>La r\u00e9solution doit \u00eatre motiv\u00e9e en d\u00e9tail et doit indiquer la raison de la n\u00e9cessit\u00e9 de l&rsquo;occupation (c&rsquo;est-\u00e0-dire la raison pour laquelle il est n\u00e9cessaire d&rsquo;occuper son terrain et pas un autre) et la raison de la n\u00e9cessit\u00e9 d&rsquo;installations sportives dans sa municipalit\u00e9.<\/p><p>Dans le cas contraire, il peut le contester et pourrait \u00eatre d\u00e9clar\u00e9 nul, le dossier d&rsquo;expropriation \u00e9tant annul\u00e9<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<section data-particle_enable=\"false\" vous).<\/li><li>Si aucun accord n&rsquo;est conclu, vous pouvez faire appel au tribunal pour qu&rsquo;un juge d\u00e9cide de la valeur la plus appropri\u00e9e pour le bien.<\/li><\/ul><h3>Paiement de l&rsquo;expropriation<\/h3><p>Le juste prix peut \u00eatre pay\u00e9 en esp\u00e8ces ou en nature (par exemple, avec un autre terrain similaire), et la mairie dispose de six mois pour effectuer le paiement.<\/p><p>\u00c0 partir du sixi\u00e8me mois, les int\u00e9r\u00eats correspondants seront dus et, si le retard est sup\u00e9rieur \u00e0 quatre ans, vous pourrez exiger que le bien soit r\u00e9\u00e9valu\u00e9.<\/p><p>Ce paiement est <strong>exon\u00e9r\u00e9 de frais et d&rsquo;imp\u00f4ts<\/strong>, bien que vous deviez d\u00e9clarer le gain ou la perte dans votre IS et \u00e9mettre la facture correspondante, qui dans ce cas porte la TVA &#8211; car il s&rsquo;agit d&rsquo;un
