Cependant, lorsque vous examinez le contrat de location de locaux commerciaux propos\u00e9 par le propri\u00e9taire, vous constatez qu&rsquo;il vous oblige \u00e0 assumer la responsabilit\u00e9 de toutes les r\u00e9parations n\u00e9cessaires, et vous n&rsquo;\u00eates pas pr\u00eat \u00e0 l&rsquo;accepter. Mais quelles sont les r\u00e9parations n\u00e9cessaires ?<\/p><p>Dans les baux, concernant les r\u00e9parations, la LAU \u00e9tablit les r\u00e8gles suivantes :<\/p><ul><li>R\u00e9parations n\u00e9cessaires.Le propri\u00e9taire est tenu d&rsquo;effectuer (sans droit d&rsquo;augmentation du loyer) les r\u00e9parations n\u00e9cessaires pour maintenir le bien en \u00e9tat d&rsquo;habitabilit\u00e9 pour servir \u00e0 l&rsquo;usage convenu (sauf si la d\u00e9t\u00e9rioration est imputable au locataire).Par exemple, r\u00e9parer un toit pour \u00e9viter les fuites ou r\u00e9parer des conduites d\u2019eau.<\/li><li>R\u00e9parations mineures dues \u00e0 l&rsquo;usure.Toutefois, les r\u00e9parations mineures rendues n\u00e9cessaires par l&rsquo;usure due \u00e0 l&rsquo;usage normal sont \u00e0 la charge du locataire.Par exemple, un drain d&rsquo;\u00e9vier bouch\u00e9, une r\u00e9paration de citerne&#8230;<\/li><\/ul><h2>Logement et locaux<\/h2><p>\u00a0<\/p><p>Ces r\u00e8gles sont obligatoires dans les baux d&rsquo;habitation, mais pas dans les baux \u00e0 usage autre que d&rsquo;habitation (locaux, entrep\u00f4ts industriels, bureaux, etc.), puisque ces baux sont r\u00e9gis en premier lieu par la volont\u00e9 des parties contractantes.Attention!Par cons\u00e9quent, la clause propos\u00e9e par le propri\u00e9taire est valable et, si vous l&rsquo;acceptez, vous risquez de devoir assumer des d\u00e9penses \u00e9lev\u00e9es dans le futur.Donc:<\/p><p>Insistez pour que le propri\u00e9taire applique les r\u00e8gles indiqu\u00e9es (au motif qu\u2019il s\u2019agit du r\u00e9gime de r\u00e9paration \u00e9tabli par la loi).<br \/>Si le propri\u00e9taire n&rsquo;est pas d&rsquo;accord et que vous souhaitez r\u00e9ellement louer les lieux, examinez certaines formules interm\u00e9diaires qui peuvent limiter votre responsabilit\u00e9 potentielle en mati\u00e8re de r\u00e9parations.<\/p><h3>Des formules plus \u00e9quilibr\u00e9es<\/h3><p>Type de travail. Si vous n&rsquo;avez d&rsquo;autre choix que d&rsquo;assumer les r\u00e9parations n\u00e9cessaires \u00e0 la pr\u00e9servation des lieux, une possibilit\u00e9 est d&rsquo;exclure de cet engagement les dommages aux \u00e9l\u00e9ments les plus importants (et qui sont \u00e0 la charge du propri\u00e9taire), car ce sont eux qui peuvent entra\u00eener des co\u00fbts plus \u00e9lev\u00e9s. Par exemple:<\/p><ul><li>Vous pouvez convenir que le propri\u00e9taire devra effectuer, \u00e0 ses frais, tous travaux d&rsquo;entretien et de r\u00e9paration n\u00e9cessaires sur la structure, la toiture, les fa\u00e7ades ou les installations des locaux.<\/li><li>Si le local est situ\u00e9 dans un immeuble divis\u00e9 en propri\u00e9t\u00e9 horizontale, ajoutez que tous travaux de r\u00e9paration ou d&rsquo;entretien effectu\u00e9s sur les parties communes de la propri\u00e9t\u00e9 seront \u00e0 la charge du propri\u00e9taire.<\/li><\/ul><p>\u00ab Le locataire, renon\u00e7ant express\u00e9ment aux dispositions de l\u2019article 30 par rapport \u00e0 l\u2019article 21 de la LAU, s\u2019engage \u00e0 effectuer les r\u00e9parations n\u00e9cessaires pour maintenir les locaux en \u00e9tat de servir \u00e0 l\u2019usage convenu, \u00e0 l\u2019exception des r\u00e9parations qui affectent la structure, la toiture, les fa\u00e7ades ou les installations des locaux, qui seront toutes assum\u00e9es et en tout \u00e9tat de cause par le bailleur \u00e0 ses frais, sans droit d\u2019augmenter le loyer pour cette raison. \u00bb<\/p><h3>Limite quantitative.<\/h3><p><br \/>Une autre option est que vous preniez en charge les r\u00e9parations n\u00e9cessaires, mais en fixant un montant limite au-del\u00e0 duquel le propri\u00e9taire sera responsable des r\u00e9parations. Note. Dans ce sens :<\/p><ul><li>Limite par r\u00e9paration. Une possibilit\u00e9 est de convenir d&rsquo;un montant maximum par r\u00e9paration, de sorte que le propri\u00e9taire soit responsable des r\u00e9parations sup\u00e9rieures \u00e0 ce montant, tandis que les r\u00e9parations inf\u00e9rieures seront \u00e0 la charge du locataire.<\/li><li>Limite globale. Une autre option est de convenir d&rsquo;un montant maximum et global, de sorte que le locataire soit responsable des r\u00e9parations jusqu&rsquo;\u00e0 un montant limite, au-del\u00e0 duquel toutes les r\u00e9parations seront \u00e0 la charge du propri\u00e9taire. Note. L&rsquo;avantage pour vous de cette deuxi\u00e8me option est que vous connaissez d\u00e9j\u00e0 \u00e0 l&rsquo;avance le montant maximum pour lequel vous pouvez \u00eatre tenu responsable de ce concept pendant toute la dur\u00e9e du contrat.<\/li><\/ul><p>Cette clause est valable, puisque les baux \u00e0 usage non r\u00e9sidentiel sont r\u00e9gis en premier lieu par la volont\u00e9 des parties.
