Il s&rsquo;agit d&rsquo;une \u00e9tape pr\u00e9liminaire obligatoire dans la plupart des cas avant d&rsquo;aller au tribunal, et c&rsquo;est un outil cl\u00e9 pour r\u00e9soudre les conflits rapidement et efficacement. L&rsquo;objectif principal du SMAC est de parvenir \u00e0 des accords qui profitent aux deux parties, r\u00e9duisant ainsi la charge que les conflits du travail pourraient g\u00e9n\u00e9rer devant les tribunaux.<\/span><\/p><p><span>Le CCSM agit comme un espace neutre o\u00f9 les employeurs et les employ\u00e9s peuvent dialoguer dans le but de parvenir \u00e0 une solution concert\u00e9e. Parmi les cas les plus courants, citons<\/span><\/p><ul><li aria-level=\"1\"><span>Licenciements : lorsqu&rsquo;un travailleur est licenci\u00e9 et qu&rsquo;il n&rsquo;est pas d&rsquo;accord avec la cause all\u00e9gu\u00e9e par l&rsquo;entreprise ou qu&rsquo;il consid\u00e8re le licenciement comme abusif. Le SMAC joue le r\u00f4le de m\u00e9diateur pour d\u00e9terminer s&rsquo;il existe une possibilit\u00e9 d&rsquo;accord, sous la forme d&rsquo;une indemnisation ou d&rsquo;une r\u00e9int\u00e9gration.<\/span><\/li><li aria-level=\"1\"><span>R\u00e9clamations salariales : ce type de conflit survient lorsque l&#8217;employ\u00e9 ne re\u00e7oit pas le salaire auquel il a droit ou qu&rsquo;il y a des divergences sur les paiements. Il peut s&rsquo;agir de salaires, d&rsquo;heures suppl\u00e9mentaires, d&rsquo;heures compl\u00e9mentaires ou d&rsquo;autres \u00e9l\u00e9ments financiers.<\/span><\/li><li aria-level=\"1\"><span>Modifications des conditions de travail : les modifications substantielles des conditions de travail, telles que les r\u00e9ductions de salaire, les modifications des horaires de travail, les modifications des t\u00e2ches ou les modifications du lieu de travail, sont \u00e9galement des motifs de saisine du SMAC.<\/span><\/li><li aria-level=\"1\"><span>Sanctions disciplinaires : il arrive que les entreprises appliquent des mesures disciplinaires que les travailleurs consid\u00e8rent comme injustifi\u00e9es ou disproportionn\u00e9es. Tout commence par la pr\u00e9sentation de la papeleta de conciliaci\u00f3n, un document d\u00e9taillant le conflit et les demandes du travailleur ou de l&rsquo;entreprise. Ce document est pr\u00e9sent\u00e9 au SMAC correspondant, en fonction du lieu o\u00f9 le service a \u00e9t\u00e9 fourni ou du si\u00e8ge de l&rsquo;entreprise.<\/span><\/p><p><span>D\u00e8s r\u00e9ception du dossier, le SMAC fixe la date de la r\u00e9union de conciliation et convoque les deux parties \u00e0 cette r\u00e9union. Lors de cette r\u00e9union, le m\u00e9diateur du SMAC agit comme un facilitateur de dialogue, aidant les parties \u00e0 n\u00e9gocier de mani\u00e8re constructive et \u00e0 explorer les solutions possibles. Au cours du processus, les parties peuvent \u00eatre accompagn\u00e9es de <a href=\"https:\/\/www.asesoriaorihuelacosta.com\/asesoria-laboral-para-empresas\/\">conseillers juridiques<\/a> ou de repr\u00e9sentants syndicaux pour les aider \u00e0 d\u00e9fendre leurs int\u00e9r\u00eats.<\/span><\/p><p><span>Si les deux parties parviennent \u00e0 un accord, une convention de r\u00e8glement est \u00e9tablie, qui est contraignante et \u00e9vite que le litige ne soit port\u00e9 devant les tribunaux.
