semaines<\/h4><p><strong>Garde d&rsquo;enfants<\/strong><\/p><p>Les salari\u00e9s <strong>ont droit \u00e0 un cong\u00e9 parental<\/strong> pour s&rsquo;occuper d&rsquo;un enfant ou d&rsquo;une famille d&rsquo;accueil pendant plus d&rsquo;un an.<\/p><p>Ce cong\u00e9, dont la <strong>dur\u00e9e maximale est de huit semaines<\/strong>, pr\u00e9sente les particularit\u00e9s suivantes :<\/p><ul><li>La p\u00e9riode d&rsquo;exercice de ce droit <strong>expire lorsque l&rsquo;enfant atteint l&rsquo;\u00e2ge de huit ans.<\/strong><\/li><li>Il peut \u00eatre pris<strong> \u00e0 temps plein ou \u00e0 temps partiel<\/strong> (bien que la r\u00e9glementation du droit au temps partiel n&rsquo;ait pas encore \u00e9t\u00e9 d\u00e9velopp\u00e9e dans les r\u00e8glements).<\/li><li>Il peut \u00eatre pris de <strong>mani\u00e8re continue ou discontinue<\/strong> (c&rsquo;est-\u00e0-dire qu&rsquo;il ne doit pas \u00eatre pris au cours de semaines cons\u00e9cutives).<\/li><\/ul><p><strong>Intermittence<\/strong><\/p><p>Les <strong>cong\u00e9s<\/strong> pouvant \u00eatre pris de <strong>mani\u00e8re continue ou discontinue<\/strong>, si un salari\u00e9 vous demande deux semaines de cong\u00e9 en 2024 et six semaines en 2025, votre employeur doit vous les accorder.<\/p><p>En fait, il <strong>pourrait m\u00eame choisir de l&rsquo;\u00e9taler<\/strong> sur plusieurs semaines chaque \u00e9t\u00e9 afin que l&rsquo;absence co\u00efncide avec les vacances scolaires, et vous ne pourriez pas refuser.<\/p><h4 class=\"subtitle2\">Hommes et femmes<\/h4><p><strong>Individualit\u00e9<\/strong><\/p><p>Ce cong\u00e9 est un <strong>droit individuel<\/strong> des travailleurs et son exercice <strong>ne peut \u00eatre transf\u00e9r\u00e9<\/strong>.<\/p><p>A ce titre :<\/p><ul><li>Il appartient au travailleur de <strong>pr\u00e9ciser les dates de d\u00e9but et de fin du cong\u00e9<\/strong> ou, le cas \u00e9ch\u00e9ant, les p\u00e9riodes de cong\u00e9.<\/li><\/ul><h3>D\u00e9lai de demande du cong\u00e9 de paternit\u00e9 \u00e0 la s\u00e9curit\u00e9 sociale<\/h3><ul><li>L&rsquo;entreprise doit \u00eatre avertie <strong>dix jours \u00e0 l&rsquo;avance<\/strong> (ou le pr\u00e9avis pr\u00e9vu par la convention collective), sauf en cas de force majeure.<\/li><li>Si deux travailleurs ou plus font valoir ce droit pour le m\u00eame enfant, l&rsquo;entreprise peut <strong>reporter l&rsquo;octroi du cong\u00e9<\/strong> pour une p\u00e9riode raisonnable, en le justifiant par \u00e9crit (et toujours apr\u00e8s avoir propos\u00e9 une alternative tout aussi flexible).<\/li><\/ul><p>Les accords peuvent pr\u00e9voir d&rsquo;autres cas dans lesquels il est consid\u00e9r\u00e9 que la prise du cong\u00e9 parental au cours de la p\u00e9riode demand\u00e9e <strong>perturberait gravement le<\/strong> bon fonctionnement de l&rsquo;entreprise.<\/p><p>Dans ce cas, l&rsquo;entreprise peut \u00e9galement reporter l&rsquo;octroi du cong\u00e9 pour une p\u00e9riode raisonnable [Statut des travailleurs, article 48.bis].<\/p><p>Par exemple, certains accords d&rsquo;entreprise ont ajout\u00e9 comme cas de refus par l&rsquo;entreprise le fait que deux personnes ou plus du m\u00eame <strong>service<\/strong> demandent un cong\u00e9 au cours de la m\u00eame p\u00e9riode.<\/p><p><strong>Apr\u00e8s le cong\u00e9 ou la r\u00e9duction<\/strong><\/p><p>Rappelons que le cong\u00e9 parental <strong>n&rsquo;est pas limit\u00e9<\/strong> par les r\u00e9ductions du temps de travail pour tutelle ou garde d&rsquo;enfant ou par le cong\u00e9 parental.<\/p><p>Il peut donc \u00eatre pris dans son int\u00e9gralit\u00e9 d\u00e8s lors que vous avez b\u00e9n\u00e9fici\u00e9 des droits pas<\/h3><h4><strong>Le cong\u00e9 parental est une suspension<\/strong><\/h4><p>Tout ce qui pr\u00e9c\u00e8de correspond \u00e0 la r\u00e9glementation existante en mati\u00e8re de cong\u00e9 parental ; il convient de noter que<span style=\"color: #ff0000;\"><strong> rien n&rsquo;est pr\u00e9cis\u00e9 quant \u00e0 la question de savoir si le cong\u00e9 est r\u00e9mun\u00e9r\u00e9<\/strong><\/span>.<\/p><p>Toutefois, \u00e0 cet \u00e9gard, le cong\u00e9 parental a \u00e9t\u00e9 r\u00e9glement\u00e9 comme une nouvelle cause de suspension du contrat :<\/p><ul><li>Ce cong\u00e9 a \u00e9t\u00e9 r\u00e9glement\u00e9 comme une <strong>nouvelle cause de suspension du contrat,<\/strong> \u00e0 l&rsquo;instar de la gr\u00e8ve ou de la suspension de l&#8217;emploi et du salaire pour des raisons disciplinaires. Par cons\u00e9quent, la suspension <strong>dispense des obligations r\u00e9ciproques de travailler et de payer pour le travail<\/strong>.<\/li><li>La s\u00e9curit\u00e9 sociale elle-m\u00eame (comme nous le verrons plus loin) reconna\u00eet express\u00e9ment le cong\u00e9 parental comme un <strong>cong\u00e9 non r\u00e9mun\u00e9r\u00e9<\/strong>.<\/li><li>En bref, il s&rsquo;ensuit que le cong\u00e9 parental est un <strong>cong\u00e9 parental non r\u00e9mun\u00e9r\u00e9 de 8 semaines<\/strong>, de sorte que l&#8217;employeur ne doit pas payer de salaire pendant que le travailleur exerce ce droit.<\/li><\/ul><h3 class=\"subtitle2\">Cotisations de s\u00e9curit\u00e9 sociale<\/h3><h4><strong>Selon la TGSS<\/strong><\/h4><p>La loi n&rsquo;indique pas non plus si l&rsquo;entreprise doit ou non verser les cotisations pendant le cong\u00e9 parental.<\/p><p>\u00c0 cet effet, il existe des cas de suspension contractuelle dans lesquels les cotisations doivent continuer \u00e0 \u00eatre vers\u00e9es (comme un TI) et des cas dans lesquels elles ne le sont pas (comme un cong\u00e9 forc\u00e9).<\/p><p>Cependant, la Tr\u00e9sorerie G\u00e9n\u00e9rale de la S\u00e9curit\u00e9 Sociale (TGSS) consid\u00e8re que <strong>l&rsquo;entreprise doit payer les cotisations<\/strong>:<\/p><ul><li>Selon la TGSS, le<strong>cong\u00e9 parental est un cong\u00e9 non r\u00e9mun\u00e9r\u00e9<\/strong>. Par cons\u00e9quent, la r\u00e8gle qui oblige les entreprises \u00e0 verser des cotisations pour les cong\u00e9s non r\u00e9mun\u00e9r\u00e9s pendant lesquels le travailleur reste inscrit \u00e0 la s\u00e9curit\u00e9 sociale, comme c&rsquo;est le cas, par exemple, pour les<strong> cong\u00e9s sans solde<\/strong> (absence non r\u00e9mun\u00e9r\u00e9e du travail parce qu&rsquo;elle n&rsquo;est pas pr\u00e9vue dans l&rsquo;accord, mais justifi\u00e9e par le travailleur), s&rsquo;applique \u00e0 ce cong\u00e9.<\/li><li>Dans ces cas, la base de cotisation applicable pour les risques communs est <strong>la base minimale<\/strong> correspondant \u00e0 tout moment au groupe de cat\u00e9gorie professionnelle du travailleur.
