Cette lettre doit mentionner les faits sp\u00e9cifiques imput\u00e9s au travailleur et la date \u00e0 laquelle le licenciement a eu lieu.<\/span><\/li><li aria-level=\"1\"><span>D\u00e9lai de recours : le travailleur dispose de 20 jours ouvrables pour contester le licenciement devant les tribunaux du travail. Pendant cette p\u00e9riode, il peut intenter une action en justice s&rsquo;il estime que le licenciement n&rsquo;est pas justifi\u00e9 ou que la proc\u00e9dure appropri\u00e9e n&rsquo;a pas \u00e9t\u00e9 suivie.<\/span><\/li><li aria-level=\"1\"><span>Possibilit\u00e9 d&rsquo;une audition pr\u00e9alable : dans le cas o\u00f9 le travailleur licenci\u00e9 est un repr\u00e9sentant l\u00e9gal des travailleurs ou un d\u00e9l\u00e9gu\u00e9 syndical, un dossier contradictoire doit \u00eatre r\u00e9alis\u00e9 au cours duquel l&rsquo;int\u00e9ress\u00e9 et les autres membres de la repr\u00e9sentation des travailleurs sont entendus.<\/span><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<section data-particle_enable=\"false\" data-particle-mobile-disabled=\"false\" class=\"elementor-section elementor-top-section elementor-element elementor-element-e02ea2f elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"e02ea2f\" data-element_type=\"section\" data-e-type=\"section\">\r\n\t\t\r\n\t\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\r\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-fb498b5\" data-id=\"fb498b5\" data-element_type=\"column\" data-e-type=\"column\">\r\n\t\t\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\r\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-4348717 elementor-widget elementor-widget-heading\" data-id=\"4348717\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Qualification du licenciement disciplinaire<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<section data-particle_enable=\"false\" data-particle-mobile-disabled=\"false\" class=\"elementor-section elementor-top-section elementor-element elementor-element-32df7e6 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"32df7e6\" data-element_type=\"section\" data-e-type=\"section\">\r\n\t\t\r\n\t\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\r\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-d6b8a01\" data-id=\"d6b8a01\" data-element_type=\"column\" data-e-type=\"column\">\r\n\t\t\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\r\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-a60b7b6 elementor-widget elementor-widget-text-editor\" data-id=\"a60b7b6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span>Une fois que le licenciement a \u00e9t\u00e9 contest\u00e9, il peut \u00eatre qualifi\u00e9 de trois mani\u00e8res diff\u00e9rentes par l&rsquo;autorit\u00e9 judiciaire :<\/span><\/p><ul><li aria-level=\"1\"><span>Le licenciement \u00e9quitable : S&rsquo;il est prouv\u00e9 que les causes all\u00e9gu\u00e9es par l&#8217;employeur sont vraies et constituent une faute grave et condamnable, le licenciement est consid\u00e9r\u00e9 comme \u00e9quitable et le travailleur n&rsquo;a pas droit \u00e0 une indemnit\u00e9 ou \u00e0 un salaire pour le traitement.<\/span><\/li><li aria-level=\"1\"><span>Licenciement abusif : Si les causes all\u00e9gu\u00e9es ne sont pas accr\u00e9dit\u00e9es ou si la proc\u00e9dure \u00e9tablie n&rsquo;a pas \u00e9t\u00e9 respect\u00e9e, le licenciement est d\u00e9clar\u00e9 abusif. Dans ce cas, l&#8217;employeur doit choisir entre la r\u00e9int\u00e9gration du travailleur avec paiement du salaire perdu (salaire de traitement) ou une indemnit\u00e9 de 33 jours de salaire par ann\u00e9e travaill\u00e9e, avec un maximum de 24 mensualit\u00e9s.<\/span><\/li><li aria-level=\"1\"><span>Licenciement nul et non avenu : Le licenciement est consid\u00e9r\u00e9 comme nul et non avenu s&rsquo;il est effectu\u00e9 en violation des droits fondamentaux et des libert\u00e9s publiques, comme la discrimination fond\u00e9e sur le sexe, la race, l&rsquo;orientation sexuelle, etc. Le licenciement de travailleurs en cong\u00e9 de grossesse, de maternit\u00e9, de paternit\u00e9 ou d&rsquo;allaitement est \u00e9galement nul. En outre, le travailleur peut avoir droit aux allocations de ch\u00f4mage s&rsquo;il remplit les conditions requises.<\/span><\/li><li aria-level=\"1\"><span>Pour l&#8217;employeur : si le licenciement est d\u00e9clar\u00e9 abusif ou nul, l&#8217;employeur peut \u00eatre confront\u00e9 \u00e0 des co\u00fbts importants, tels que le paiement de frais de traitement et d&rsquo;indemnit\u00e9s.
