<strong>paid leave<\/strong> (i.e. they can be absent from work with pay) in <strong>the event of<\/strong> a serious accident or illness, hospitalisation or surgery without hospitalisation requiring home rest of the following persons:<\/p><ul><li><strong>Of their spouse<\/strong> or unmarried partner.<\/li><li><strong>Relatives up to the second degree of<\/strong> consanguinity or affinity (children, parents, etc.), including the blood relative of the common-law partner.<\/li><li><strong>Any other person other than the aforementioned<\/strong> who lives with the worker in the same home and requires their effective care.<\/li><\/ul><h3><strong>Justification for leave<\/strong><\/h3><p>In order to take leave, <strong>your employee must give you advance notice<\/strong> so that you can organise yourself (so you cannot just &#8220;take&#8221; the leave).<\/p><p>In addition, he or she <strong>must provide proof of the facts<\/strong> justifying the leave (e.g. proof from the hospital).<\/p><p>In your case, your employee gave you advance notice and provided you with medical proof of your mother&#8217;s hospitalisation.<\/p><p>However, <strong>you have seen on her social media<\/strong> (in Instagram photos) that during the first two days of her leave she was on a trip to the beach with her friends&#8230;<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<section data-particle_enable=\"false\" data-particle-mobile-disabled=\"false\" class=\"elementor-section elementor-top-section elementor-element elementor-element-fbd8303 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"fbd8303\" data-element_type=\"section\" data-e-type=\"section\">\r\n\t\t\r\n\t\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\r\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-88f0f79\" data-id=\"88f0f79\" data-element_type=\"column\" data-e-type=\"column\">\r\n\t\t\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\r\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-61e9727 elementor-widget elementor-widget-heading\" data-id=\"61e9727\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">The employee abuses your trust<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<section data-particle_enable=\"false\" data-particle-mobile-disabled=\"false\" class=\"elementor-section elementor-top-section elementor-element elementor-element-16737c8 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"16737c8\" data-element_type=\"section\" data-e-type=\"section\">\r\n\t\t\r\n\t\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\r\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-9013969\" data-id=\"9013969\" data-element_type=\"column\" data-e-type=\"column\">\r\n\t\t\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\r\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-cf52958 elementor-widget elementor-widget-text-editor\" data-id=\"cf52958\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3><strong>You can penalise the <\/strong><b>employee for the leave<\/b><\/h3><p>Such &#8220;misuse&#8221; of paid leave granted by your company <i>is a breach of contractual good faith and a breach of trust<\/i>.<\/p><p><strong>You may therefore penalise the employee.<\/strong><\/p><p>To do so:<\/p><ul><li>Go to your agreement and check how this type of non-compliance is classified.<\/li><\/ul><p>Normally, such behaviour is classified as very serious misconduct.<\/p><ul><li><a href=\"https:\/\/www.asesoriaorihuelacosta.com\/asesoria-y-gestoria-laboral\/\" rel=\"noopener\"><strong>See what sanction can be imposed<\/strong><\/a> for very serious misconduct.<\/li><\/ul><p>Although you could resort to disciplinary dismissal (the <a href=\"https:\/\/noticias.juridicas.com\/base_datos\/Laboral\/rdleg1-1995.html\" rel=\"noopener\">Workers&#8217; Statute<\/a> itself allows you to do so in cases of breach of good faith and breach of trust), it is advisable to impose a less damaging sanction.<\/p><p>Specifically, a suspension from employment and salary.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<section data-particle_enable=\"false\" data-particle-mobile-disabled=\"false\" class=\"elementor-section elementor-top-section elementor-element elementor-element-813fdf0 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"813fdf0\" data-element_type=\"section\" data-e-type=\"section\">\r\n\t\t\r\n\t\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\r\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-b07256b\" data-id=\"b07256b\" data-element_type=\"column\" data-e-type=\"column\">\r\n\t\t\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\r\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-8e9a7f5 elementor-widget elementor-widget-heading\" data-id=\"8e9a7f5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Paid leave under the workers' statute misused in practice<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<section data-particle_enable=\"false\" data-particle-mobile-disabled=\"false\" class=\"elementor-section elementor-top-section elementor-element elementor-element-85c6229 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"85c6229\" data-element_type=\"section\" data-e-type=\"section\">\r\n\t\t\r\n\t\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\r\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-78fb9cc\" data-id=\"78fb9cc\" data-element_type=\"column\" data-e-type=\"column\">\r\n\t\t\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\r\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-0a43b3a elementor-widget elementor-widget-text-editor\" data-id=\"0a43b3a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3><strong>Our Recommendation<\/strong><\/h3><p>The purpose of imposing a less damaging sanction and not resorting to dismissal out of hand is as follows:<\/p><ul><li>If you give notice of dismissal and the person concerned contests it, you run the risk that a judge will consider that the facts are not serious enough to dismiss.<\/li><\/ul><p>In that case, the dismissal would be declared unfair and you would have to reinstate the employee or pay him\/her the maximum compensation.<\/p><ul><li>On the other hand, if you first give notice of a suspension of employment and pay, a judge will most likely consider that the sanction imposed is in line with the seriousness of the facts. Moreover, if this is not the case and the sanction is eventually revoked, you will only be ordered to pay the wages accrued during the days of the suspension of employment and salary.<\/li><\/ul><h3><strong>The employee is in breach again<\/strong><\/h3><p>If, afterwards, your employee again commits a very serious breach, you will be able to dismiss him.<\/p><p>Even if he contests the dismissal, the fact that he has a disciplinary sanction on his record will be an aggravating factor that the judge will assess and that will give your company more guarantees that the dismissal will be declared fair (without having to pay any compensation).<\/p><div class=\"conclusion\">\u00a0<\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<section data-particle_enable=\"false\" data-particle-mobile-disabled=\"false\" class=\"elementor-section elementor-top-section elementor-element elementor-element-267ef59 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"267ef59\" data-element_type=\"section\" data-e-type=\"section\">\r\n\t\t\r\n\t\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\r\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-472fdbe\" data-id=\"472fdbe\" data-element_type=\"column\" data-e-type=\"column\">\r\n\t\t\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\r\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-d6d8c28 elementor-invisible elementor-widget elementor-widget-text-editor\" data-id=\"d6d8c28\" data-element_type=\"widget\" data-e-type=\"widget\" data-settings=\"{&quot;_animation&quot;:&quot;fadeInLeft&quot;}\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3 class=\"conclusion\" style=\"text-align: center;\">The &#8220;misuse&#8221; of paid leave is a breach of contractual good faith and a breach of trust.<\/h3><div>\u00a0<\/div><h4 class=\"conclusion\">Therefore, <strong>go to your collective agreement and sanction the employee.<\/strong><\/h4>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>In this article we will take a look at the paid time off in the workers&#8217; statute with an example.
