href=\"https:\/\/www.boe.es\/buscar\/doc.php?id=BOE-A-2023-15135\" rel=\"noopener\">law<\/a><\/strong> says <strong><a href=\"https:\/\/www.boe.es\/buscar\/doc.php?id=BOE-A-2023-15135\" rel=\"noopener\">about parental leave<\/a><\/strong><\/h3><h4 class=\"subtitle2\">Up to eight weeks<\/h4><p><strong>Childcare<\/strong><\/p><p>Employees <strong>are entitled to parental leave<\/strong> to care for a child or foster child for more than one year.<\/p><p>This leave, the <strong>maximum duration of<\/strong> which <strong>is eight weeks<\/strong>, has the following special features :<\/p><ul><li>The period for exercising this right <strong>expires when the child reaches the age of eight.<\/strong><\/li><li>It can be taken<strong> full-time or part-time<\/strong> (although the regulation of part-time entitlement has not yet been developed in the regulations).<\/li><li>It can be taken <strong>continuously or discontinuously<\/strong> (i.e. it does not have to be taken in consecutive weeks).<\/li><\/ul><p><strong>Intermittence<\/strong><\/p><p>Since <strong>leave<\/strong> can be taken <strong>continuously or discontinuously<\/strong>, if an employee asks you for two weeks&#8217; leave in 2024 and six weeks&#8217; leave in 2025, your employer must grant it.<\/p><p>In fact, it <strong>could even choose to spread it<\/strong> over several weeks each summer so that the absence coincides with school holidays, and you would not be able to refuse.<\/p><h4 class=\"subtitle2\">Men and women<\/h4><p><strong>Individuality<\/strong><\/p><p>This leave is an <strong>individual right<\/strong> of workers, and its exercise <strong>cannot be transferred<\/strong>.<\/p><p>To this end:<\/p><ul><li>It is up to the worker to <strong>specify the start and end date of the leave<\/strong> or, where applicable, the periods of leave.<\/li><\/ul><h3>Deadline for applying for paternity leave social security<\/h3><ul><li>The company must be notified <strong>ten days in advance<\/strong> (or the advance notice stipulated in the collective agreement), except in cases of force majeure.<\/li><li>If two or more workers generate this right for the same child, the company may <strong>postpone the granting of leave<\/strong> for a reasonable period, justifying this in writing (and always after having offered an equally flexible alternative).<\/li><\/ul><p>Agreements may provide for other cases in which it is considered that taking parental leave in the requested period <strong>seriously disrupts<\/strong> the proper functioning of the company.<\/p><p>In such a case, the company may also postpone the granting of leave for a reasonable period.<\/p><p>For example, some company agreements have added as a case of refusal by the company the fact that two or more persons from the <strong>same department<\/strong> apply for leave in the same period.<\/p><p><strong>After leave of absence or reduction<\/strong><\/p><p>Remember that parental leave <strong>is not limited<\/strong> by reductions in working hours for legal guardianship or childcare or by parental leave.<\/p><p>Therefore, it may be taken in its entirety after having availed of the aforementioned rights.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<section data-particle_enable=\"false\" data-particle-mobile-disabled=\"false\" class=\"elementor-section elementor-top-section elementor-element elementor-element-37e5686 elementor-section-boxed elementor-section-height-default style=\"text-align: center;\">Taking parental leave for childcare, breastfeeding leave or reduced working hours to care for a child does not restrict the period of parental leave, which may be taken in its entirety at the end of parental leave.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<section leave<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<section data-particle_enable=\"false\" data-particle-mobile-disabled=\"false\" class=\"elementor-section elementor-top-section elementor-element elementor-element-61f269a elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"61f269a\" data-element_type=\"section\" data-e-type=\"section\">\r\n\t\t\r\n\t\t\t\t\t\t\t<div class=\"elementor-container data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3 class=\"subtitle2\">What the law on parental leave doesn&#8217;t say<\/h3><h4><strong>Parental leave is a suspension<\/strong><\/h4><p>All of the above is the existing regulation on parental leave; note that<span style=\"color: #ff0000;\"><strong> nothing is specified as to whether the leave is paid leave<\/strong><\/span>.<\/p><p>However, in this respect:<\/p><ul><li>This leave has been regulated as a <strong>new cause for suspension of the contract,<\/strong> like strike action or suspension of employment and pay for disciplinary reasons. Therefore, the suspension <strong>exempts from the reciprocal obligations to work and pay for work<\/strong>.<\/li><li>Social security itself (as will be seen below) expressly recognises parental leave as <strong>unpaid leave<\/strong>.<\/li><li>In short, it follows that parental leave is an <strong>unpaid parental leave of 8 weeks<\/strong>, so that the employer does not have to pay wages while the worker is exercising this right.<\/li><\/ul><h3 class=\"subtitle2\">Social security contributions<\/h3><h4><strong>According to the TGSS<\/strong><\/h4><p>The law also does not indicate whether or not the company must pay contributions during parental leave.<\/p><p>For these purposes, there are cases of contractual suspension in which contributions must continue to be paid (such as a TI) and cases in which they do not (such as an enforced leave of absence).<\/p><p>However, the General Treasury of the Social Security (TGSS) considers that <strong>the company must pay contributions<\/strong>:<\/p><ul><li>According to the TGSS,<strong>parental leave is unpaid leave<\/strong>. Therefore, the rule that obliges companies to pay contributions for unpaid leave during which the worker remains registered with the Social Security, as happens, for example, with<strong> unpaid leave<\/strong> (an unpaid absence from work because it is not provided for in the agreement, but is justified by the worker), applies to it.<\/li><li>In these cases, the contribution base applicable for common contingencies is <strong>the minimum base<\/strong> corresponding at any given time to the worker&#8217;s professional category group.
