data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3>Capitalisation reserve until 2023, 10%.<\/h3><p><a href=\"https:\/\/www.ineaf.es\/tribuna\/la-reserva-de-capitalizacion-aspectos-contables-y-fiscales\/\" target=\"_blank\" rel=\"noopener\">If your company has benefited from the \u201ccapitalisation reserve\u201d<\/a> incentive in 2023 or in any previous year, it will have been able to reduce the taxable base of its Corporate Tax (IS) by up to 10% of the amount by which it has increased its funds:<\/p><ul><li>This increase is the positive difference between the equity at the end of the year \u2013 without including its results \u2013 and the equity at the beginning, without the profits of the previous year.<\/li><li>In this calculation, you should not take into account as equity \u2013 among other items \u2013 neither the contributions of the partners, nor the capital increases or equity by offsetting credits, nor the legal reserves.<\/li><\/ul><h3>Capitalisation reserve from 2024, 15%<\/h3><p>Well, with effect for the years starting from January 1, 2024, it has been approved that said reduction percentage be 15%.<\/p><p>So, <strong>from now on it will be even more interesting for your company to declare a higher accounting result<\/strong>, so that the increase in your equity is higher and, consequently, you can enjoy a greater reduction in your IS.<\/p><h3>If you have an SME: minimum depreciation.<\/h3><p><a href=\"https:\/\/www.asesoriaorihuelacosta.com\/en\/integral-consultancy-and-management-of-companies\/\" target=\"_blank\" rel=\"noopener\">If your company is small<\/a> (generally it will be if it invoices less than ten million euros per year), try to record the minimum possible depreciation in order to declare a higher accounting result.<\/p><h4>This will not make you pay more tax!<\/h4><p>Do not forget that, when depreciating the assets you have acquired new, your company \u2013 being small \u2013 can deduct each year, as tax depreciation, up to double the depreciation resulting from applying twice the maximum coefficient of tables.<\/p><p><span style=\"text-decoration: underline;\">This amount is deductible regardless of the depreciation recorded.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<section data-particle_enable=\"false\" data-particle-mobile-disabled=\"false\" class=\"elementor-section elementor-top-section elementor-element elementor-element-47b30f3 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"47b30f3\" data-element_type=\"section\" data-e-type=\"section\">\r\n\t\t\r\n\t\t\t\t\t\t\t<div class=\"elementor-container reserve<\/h2><\/div><style>.porto-u-55ca8359258f9a412be7e73af65d2aac.porto-u-heading{text-align:center}<\/style><\/div>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<section data-particle_enable=\"false\" data-particle-mobile-disabled=\"false\" class=\"elementor-section elementor-top-section elementor-element elementor-element-04b7cdb elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"04b7cdb\" data-element_type=\"section\" data-e-type=\"section\">\r\n\t\t\r\n\t\t\t\t\t\t\t<div class=\"elementor-container data-element_type=\"column\" data-e-type=\"column\">\r\n\t\t\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\r\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-2b64372 elementor-widget elementor-widget-text-editor\" data-id=\"2b64372\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3>Until 2023, five years<\/h3><p>On the other hand, in order to consolidate this incentive, until now:<\/p><ul><li>Your company had to maintain the increase in equity on which it had calculated the reduction for the<strong> five years<\/strong> following the end of the year in which the incentive was applied, unless there were accounting losses (in which case, even if equity decreased, there would be no breach).<\/li><li>You also had to create an <strong>unavailable reserve<\/strong> equal to the reduction applied and keep it on the balance sheet for the five years indicated.<\/li><\/ul><h3><br \/>From 2024, three years<\/h3><p>Well, from 2024 these maintenance periods are reduced to just three years. This mitigates one of the main drawbacks of this incentive:<strong> the limitation of distributing dividends or reserves during the maintenance period<\/strong>.<\/p><p>From now on, your company will have to wait less time to make these distributions.<\/p><h4>Capitalisation reserve from previous years<\/h4><p>Also, please note that this reduction in the maintenance period is also applicable to <strong>reductions computed<\/strong> in the 2023 financial year and in previous years and whose maintenance period has not yet expired at the beginning of 2024.<\/p><p><strong>Thus, for example:<\/strong><\/p><ul><li><span style=\"text-decoration: underline;\">If your company applied the capitalisation reduction in the 2021 IS<\/span>, you will only have to maintain the increase in equity and the capitalisation reserve accounted for until the end of the 2024 financial year (instead of until 2026, which was when the five-year period expired).<\/li><li><span style=\"text-decoration: underline;\">If you applied the reduction in the 2020 IS<\/span> or in previous years, you will now be able to use the capitalisation reserve and distribute dividends or reserves without losing the reductions applied in those years.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>From 2024, the capitalisation allowance reduction has been increased from 10 to 15%.
