Therefore, the minimum withholding rate applicable to this type of contract, which is 2%, cannot be applied.<\/p><p>In view of the doubts that have arisen, the <a href=\"https:\/\/petete.tributos.hacienda.gob.es\/consultas\/?num_consulta=V0040-23\" target=\"_blank\" rel=\"noopener\">Directorate General of Taxes (DGT)<\/a> recently resolved a query indicating the guideline to follow: a permanent seasonal worker, although working less than 12 months a year, does not have a contract of less than one year, therefore, the tax rate that has to be applied in the <a href=\"http:\/\/chrome-extension:\/\/efaidnbmnnnibpcajpcglclefindmkaj\/https:\/\/www.ine.es\/metodologia\/t45\/t45p062f.pdf\" target=\"_blank\" rel=\"noopener\">withholding of Personal Income Tax (IRPF)<\/a> would be higher.<\/p><p>This was a controversial issue because, in fact, the law was not clear. Therefore, only from 2023 onwards, there is a clear guideline on how personal income tax withholdings for this group should be accounted for.<\/p><p>Basically, the income criterion will be applied, with exceptions.<\/p><p>However, there would be some possibilities to reduce the withholding, in general, which are those applied in the Personal Income Tax Law 35\/2006 and in article 81.1 of the tax regulations: according to income, number of children and family situation.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<section data-particle_enable=\"false\" data-particle-mobile-disabled=\"false\" class=\"elementor-section elementor-top-section elementor-element elementor-element-3dcc1b1 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"3dcc1b1\" data-element_type=\"section\" data-e-type=\"section\">\r\n\t\t\r\n\t\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\r\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-9d434e9\" data-id=\"9d434e9\" data-element_type=\"column\" data-e-type=\"column\">\r\n\t\t\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\r\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-5818676 elementor-widget elementor-widget-heading\" data-id=\"5818676\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Personal income tax withholdings for permanent workers in 2024 and exemptions<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<section data-particle_enable=\"false\" data-particle-mobile-disabled=\"false\" class=\"elementor-section elementor-top-section elementor-element elementor-element-6be19c8 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"6be19c8\" data-element_type=\"section\" data-e-type=\"section\">\r\n\t\t\r\n\t\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\r\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-074c9fb\" data-id=\"074c9fb\" data-element_type=\"column\" data-e-type=\"column\">\r\n\t\t\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\r\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-2d350b0 elementor-widget elementor-widget-text-editor\" data-id=\"2d350b0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The key to not applying the withholding tax would be the annual amounts received, not the number of months worked.<\/p><p>The criteria, for 2024, is as follows depending on income, although it may vary depending on what the regional tax bracket applies:<\/p><ul><li>Up to 12,450 euros, 19 %.<\/li><li>Between 12,450 and 20,200 euros, 24%.<\/li><li>From 20,200 euros to 35,200 euros, 30%.<\/li><li>From 35,200 to 60,000 euros, 35%.<\/li><li>From 60,000 to 300,000 euros, 45%.<\/li><li>From 300,000 euros and above, 47%.<\/li><\/ul><p>This is the default amount, but the State only has regulatory power over 50% of the tax.<\/p><p>The other 50 %, which is the regional tranche, would be used to make up the sum.<\/p><p>In any case, the trend is that, for low incomes, this tax rate is even lower in most territories.<\/p><p>This complexity makes <strong><a href=\"https:\/\/www.asesoriaorihuelacosta.com\/en\/criteria-to-take-into-account-when-choosing-a-business-consulting-firm\/\" target=\"_blank\" rel=\"noopener\">business consultancy advisable.<\/a><\/strong><\/p><p>In addition, there are some permanent, discontinuous workers who would be exempt from personal income tax withholding. Which ones?<\/p><p>Those who are single and who earn less than 15,876 euros gross per year.
