However, it is <span style=\"text-decoration: underline;\">essential to review what is agreed in the purchase contract<\/span>, as the parties may agree on a different distribution.<\/p><p>According to traditional practice in our area\u00a0 <span style=\"font-weight: 400;\">(Orihuela Costa , Torrevieja, Pilar de la Horadada, Alicante)<\/span> the seller usually pays:<\/p><ul><li>The municipal capital gains tax (Impuesto sobre el Incremento del Valor de los Terrenos de Naturaleza Urbana).<\/li><li>The costs of cancellation of the mortgage, if any.<\/li><\/ul><p>The buyer is generally responsible for:<\/p><ul><li>Notary fees related to the deed of sale.<\/li><li>The costs of registration in the Land Registry.<\/li><li>The Transfer Tax in Alicante (10% in the case of second-hand properties) or the VAT and the Documented Legal Act (1,5 %for new properties).<\/li><li>The appraisal, in the event that it is necessary for the granting of a mortgage.<\/li><li>Notary, registry and tax expenses derived from the mortgage, if a new mortgage is constituted.<\/li><\/ul><p><strong>Important,<\/strong> the law says that the seller will pay the first copy of the deed and the buyer the following copies.
