INFORMATION ABOUT RESIDENCIA IN SPAIN

On Saturday 04/07/20 the BOE published the Resolution of July 2, 2020, of the Undersecretariat, which publishes the joint Instruction of the General Directorate of Migrations and the General Directorate of the Police, by the that the procedure for issuing the residence document provided for in Article 18.4 of the Withdrawal Agreement of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community is determined.

It is known of the controversy of whether or not it is mandatory to request the new TIE card by British citizens who have been granted residence in Spain.

As of 07/01/20 no Union Citizen Registration Certificates were issued to UK nationals so they must do so in accordance with the accompanying instructions.

From now on 2 procedures are established

1 – For nationals of the United Kingdom who are holders of the Union citizen registration certificate or relatives of these holders of Union citizen family card.

These people may go, by appointment, to the national police station (Police area of ??the immigration office) to request, the new residence document is not mandatory and there is no deadline to request it.

2 – Those who, being residents or entering Spain as of today, 07/06/20, and until 12/31/20 (end of the transitional period) are not holders of a registration certificate or citizen’s family card of the Union.

These people will have to do two procedures:

1 – In the immigration office, by appointment, personally or through a representative or by electronic means.

2 – Once the document has been granted, the interested party must request, within a period of one month from the notification of the grant resolution, the issuance of the document with the national police. The prior appointment will be requested through the foreigner’s prior appointment website:

BRITISH CITIZENS AND THEIR FAMILY MEMBERS (BREXIT).

The issuance of the document involves the payment of fee in the Model 790 code 012
